Returns Policy for One-Off Furniture Pieces Sculpture’s and Artworks 

Thank you for choosing Art by Nature. All our pieces are unique, one-of-a-kind, and often custom-made, please review the following returns policy carefully to understand the terms and conditions of your purchase. 

  1. Nature of the Artwork

Each piece is a one-off creation, designed, crafted, and completed exclusively for the buyer (or chosen specifically from existing works). Due to the unique, artistic, and personal nature of the pieces, our policy on returns, cancellations, and refunds differs from standard retail products. 

  1. Non-Refundable Deposit

A non-refundable deposit is required at the time of purchase to secure your artwork. This deposit covers the time, effort, and materials involved in creating a bespoke piece, or in reserving an existing artwork for you. Once the deposit is paid, it is non-refundable under any circumstances. 

  1. Final Approval

Before the work is finalized or delivered, you will be provided with the opportunity to approve preliminary designs, sketches, or photographs of the artwork (if applicable). Once you give final approval to the design or the completed work, the sale is considered final. 

  • Custom Works: For custom commissions, changes to the agreed design may be allowed before the work begins. However, once the creation of the piece has started, no further changes or cancellations will be accepted. 
  • Existing Works: If purchasing a pre-existing one-off artwork (e.g., a painting, sculpture), we will provide high-quality images and descriptions for your review before confirming the sale. 
  1. Damaged or Faulty Items

While every effort is made to ensure your piece is delivered in perfect condition, we understand that accidents can happen during shipping or delivery. If your work arrives damaged or defective, please contact us immediately (within [7] days) of receipt with photographic evidence of the damage. In such cases, we will: 

  • Arrange for the return of the artwork. 
  • Repair the artwork, if possible. 
  • Offer a replacement (if applicable), or 
  • Provide a refund, depending on the situation. 

Please retain all packaging materials for any damage claims, as this may be necessary for insurance purposes. 

 

  1. No Returns for Change of Mind

As all artworks are unique, we do not accept returns or exchanges for change of mind. Once you have committed to purchasing the artwork, the sale is final, and no returns will be accepted for reasons such as: 

  • Personal preference 
  • Change of mind 
  • Incorrect choice of color, style, or theme 
  1. Exchanges

Since each artwork is unique and often cannot be replicated, exchanges are not offered. We encourage you to carefully consider your purchase before finalizing it. If in doubt, please feel free to ask for more information or request a consultation before committing to a purchase. 

  1. Cancellations
  • Before Work Begins: You may cancel your order and receive a refund of any payments made, minus the non-refundable deposit, if the artwork has not yet been started or created. 
  • After Work Begins: If the creation of a commissioned or bespoke artwork has already commenced, cancellations will not be accepted, and you will be required to pay the full agreed price. This includes any costs already incurred during the creation of the piece (such as materials, design work, etc.). 
  1. Shipping and Delivery

We take great care in packaging and delivering each artwork to ensure it reaches you in perfect condition. However, once the artwork is shipped, we cannot be held responsible for any damage that occurs during the shipping process unless the damage is reported upon receipt and the proper steps are followed. 

  • Shipping Costs: Shipping costs for all artworks are typically borne by the Buyer unless otherwise specified. If damage occurs during shipping, we will assist you in making a claim with the carrier. 
  • International Shipments: For international shipments, the Buyer is responsible for any customs duties, taxes, or additional fees incurred. 
  1. Refunds

Refunds will only be issued in cases where the work is deemed to be faulty, damaged, or not as described (e.g., incorrect artwork sent). Refunds are not available simply because the Buyer changes their mind after purchase. Refund requests must be made within [7] days of receiving the artwork. 

  • In case of a refund, the Buyer may be required to return the artwork in its original condition, and the Buyer will be responsible for return shipping costs unless the artwork was defective or damaged upon arrival. 
  1. Quality Guarantee

We take pride in the quality of our works of furniture, sculptures and art . Each piece is carefully created or sourced by experienced artists. If your artwork is defective or damaged due to a fault in materials or craftsmanship, we will arrange for a repair or replacement where feasible. 

  • Warranty Period: We provide a limited warranty for defects in the workmanship or materials for a period of 12 to 60 months from the date of purchase. 
  • The warranty does not cover normal wear and tear, accidental damage, or misuse. 
  1. Intellectual Property

All artwork remains the intellectual property of the artist unless otherwise agreed in writing. The Buyer agrees not to reproduce or sell the artwork without the artist’s permission. Buyers are purchasing the physical artwork, not the rights to reproduce or sell copies of the work. 

  1. Legal Rights

This returns policy is in accordance with consumer protection laws in [Jurisdiction]. This policy does not affect your statutory rights. If the artwork is found to be defective or not as described, the Buyer may have additional legal rights under applicable law.
